Importance of Public Policies

• Public policies in Turkey directly shape thestructure and direction of the healthcaresystem. In areas such as medical liability andhealth tourism, the state’s regulatory roleboth protects patient rights and increases thequality of healthcare services. These policiesensure the safety of citizens while laying thefoundation for transforming Turkey into aninternational health hub.

Medical Liability Laws

• Turkey has various regulations aimed atpreventing patient harm and defining theresponsibilities of healthcare professionals in thecase of malpractice. However, this legal structureis still fragmented and based on multiple sources, including: – Turkish Code of Obligations, – TurkishPenal Code, – Patient Rights Regulation, – BasicLaw on Health Services. This results in a complexframework with uncertainties. In practice, thiscomplexity often requires the support ofspecialized attorneys for both service providersand recipients.

Impact of Health Tourism

• The quality of the medical liability system directlyaffects health tourism. When there is a strong andpredictable legal system: – International patients feelsecure traveling to Turkey, – Healthcare institutionsraise their quality standards, – Risk management isimproved, – Foreign currency income increases, – Theinternational reputation of the country grows. However, the complexity of legal processes andlanguage barriers can deter foreign patients. Hospitalsattempt to overcome these issues through properinformation, marketing, and health tourism guidance.

Government Support for Health Tourism

• The Turkish government considers health tourism adevelopment priority. Accordingly: – Standardizedaccreditation systems have been implemented, -Financial incentives are provided, – Massive healthcomplexes have been built in major cities under thename of City Hospitals, – Simplified visa processes havebeen introduced. Additionally, institutions like USHAŞhelp organize international patient flow. Yet, thesustainability of this growth depends on maintaininglegal safety at an international level, ensuring highservice quality, and offering attractive price indexes

Challenges in Medical Liability

Despite the progress and investments, structural problems persist in the medicalliability system, such as: – Fragmented andcomplex legal regulations, – Heavy criminalrisks for physicians, – Defensive medicalpractices, – Lack of specialized courts andattorneys in this field, – Major language andlegal knowledge gaps for foreign patients. These issues may negatively affect healthcareservice quality and patient satisfaction

Policy Recommendations

• To further improve the current situation, wepropose the following: – Establish specializedmedical courts to ensure expert judicialprocesses, – Standardize compensation amountsto reduce uncertainty, – Make alternative disputeresolution methods like arbitration andmediation mandatory, – Strengthen informedconsent procedures with language support, -Create compensation funds to avoid individualvictimization of physicians, – Enact acomprehensive and accessible Medical LiabilityLaw by updating existing regulations.

Conclusion

• As of today, thanks to public policies, Turkey hasmade great strides in healthcare and has becomeone of the world leaders in health tourism. However, to sustain this success, it is essential tostrike a balance between legal safety and thesupport of healthcare professionals. I believe thatnecessary reforms will increase the confidence ofboth national and international patients and takeTurkey to a much more advanced and leadingposition in this field. Thank you for listening.
